The High Court has further adjourned the Civil case number 238 of 2019 between Hon. Matthew Wale and Prime Minister Manasseh Sogavare to 17 May 2019.
The case was listed for mention and direction before Chief Justice Sir Albert Palmer.
In court today, Hon. Sogavare’s lawyer Tim Matthews made mention an application to strike off the judicial review claim made by Hon. Wale’s lawyer pursuant to Rule 9.75 of the Solomon Islands Courts (Civil Procedure) Rules 2007.
Mr Matthews said the claim showed no course of action known to law.
But Mr. Wale’s Lawyer Gabriel Suri said the application to strike out the judicial review would be quite tricky considering specific rules that deals with applications to strike off the claim.
Chief Justice Sir Albert Palmer after receiving preliminary matters adjourned the matter to 17 May 2019.
This is to allow the court to prepare hearing for the application to strike out the application made by the second and fourth defendant to strike out the judicial review civil case 244 of 2019.
