The High Court has acquitted a man charged with rape and buggery this morning, due to insufficient evidence.
The man was charged with one count of rape and one count of buggery, offences he allegedly committed in Lata, Temotu province in 2008.
In Court this morning, the prosecution applied for a Nolle, a decision not to prosecute further and asked for the accused to be discharged.
But the accused’s lawyer said his client should be acquitted, and therefore trial should proceed with the prosecution witnesses.
The prosecution responded that their witnesses will not be able to prove the charges because there was insufficient evidence.
Chief Justice Palmer then ordered the accused be acquitted and the case washed out.
Meanwhile, the trial will begin tomorrow for a man charged with raping a woman at the Koloa’ridge cemetery in 2013.
The trial will begin 9.30am at the High Court.
