Legal proceedings will continue against the Minister of Communication and Aviation Peter Shanel Agovaka after the High Court refused his stay application yesterday.
Mr. Shanel applied to temporarily halt judicial proceedings against him at the Magistrate Court while an appeal against the matter is being progressed at the High Court.
A hearing was conducted Tuesday this week.
However, Justice Emmanuel Kouhota dismissed the application.
Justice Kouhota says Shanel’s grounds for the stay was the same grounds he had stated in an earlier application against his case at the Magistrate Court.
The Magistrate Court refused his application at the time.
Justice Kouhota says since the first application was already refused, he cannot grant the stay based on the same grounds.
Former Police Minister Shanel was charged with one count of assault causing actual bodily harm.
He stood trial at the Magistrate Court which ended in January this year.
The ruling yesterday, means the Magistrate Court can now deliver the judgement on his trial.
